You Have The Right To Choose
Your Home Health Care Service Provider
Federal Hospital law guarantees a person's right to choose the home care provider that he or she wants in their home. There are many options available and we respect your right to choose the services that meet your unique home care needs.
If home care is recommended:
- The hospital is required to give you a list of all home care agencies that can service you at home.
- All patients have the right of freedom of choice of providers
- Discharge Planners and Case Managers have legal and ethical obligations to honor this right.
Federal statutes of the Medicare and Medicaid programs guarantee Medicare beneficiaries and Medicaid recipients the right of freedom of choice of providers. When these patients voluntarily express a preference for a home health agency these choices must be honored.
The Balanced Budget Act of 1997 requires hospitals to develop a list of Home Health Agencies that meet the following criteria:
- Medicare certified
- Provide services in geographic areas where patients reside
- Ask to be on the list
- If hospitals have a disclosable financial interest in an agency placed on the list it must be disclosed on the list
- This list must be given to all patients who may benefit from home health services so they can choose the agency they wish to provide services to them
- Hospitals may lose reimbursements from Medicare and Medicaid programs if they do not meet the Hospital Conditions of Participation (COP's)
